Message To Officers: Upholding Our Duty And Respecting The Rule Of Law

Colleagues,

I wish to take this opportunity to acknowledge and commend the officers involved in the investigation and enforcement action concerning members of the Kollision Band. Your actions reflected your commitment to maintaining public order, enforcing the law, and carrying out your duties in accordance with your understanding of the legal requirements placed before you.

As police officers, our responsibility is to investigate incidents, gather evidence, take appropriate enforcement action where necessary, and place matters before the justice system. Once this process advances, other independent institutions within our constitutional framework have their respective roles to perform.

The decision by the Director of Public Prosecutions (DPP) to discontinue the prosecution is an exercise of the constitutional authority vested in that office. It is important that we understand and respect that authority. Such decisions form part of the checks and balances within our justice system and should not be viewed as criticism of, or an attack on, the Police Force or the officers involved.

The Police and the Office of the DPP are partners in the administration of justice. While there may be occasions when prosecutorial decisions differ from the initial enforcement position taken by police, this does not diminish the importance of the work performed by our officers. Each institution must be allowed to independently discharge its responsibilities in accordance with the Constitution and the law.

I therefore encourage all officers to remain professional, motivated, and steadfast. Continue to enforce the laws of our Federation fairly, impartially, and without fear or favour. Our duty is not influenced by popularity, public opinion, or the eventual outcome of any particular matter. Our duty is guided by law, evidence, integrity, and our oath of office.

Let us continue to serve with confidence, discipline, and respect for the justice system we are sworn to uphold.
